Terms of Service

These terms are an agreement between you (the business using Tomtegrid, the “client”) and Fencesync Forge Systems Private Limited (“we”). By creating an account you accept them.

1. The service

Tomtegrid uses AI to plan and publish marketing content, reply to your customers, track leads and orders, and manage ads on platforms you connect. Features depend on your plan and on approvals from Meta and Google.

2. Your account and connections

You must own or be authorised to manage the accounts you connect.
You can disconnect any account at any time.
You are responsible for keeping your login (your mobile number and WhatsApp) secure.

3. Your content and approvals

You own your photos, brand and content. You allow us to use them to provide the service.
You decide how much freedom the AI has: approve each post, approve automatically after a set time, or always post. For the first 14 days every post needs your approval.
You are responsible for the accuracy of prices, offers and claims in your brand kit. Our safety checks reduce mistakes but cannot catch everything.
You must follow the rules of Meta, WhatsApp and Google, including their advertising policies.

4. Ads and money

Ad spend is paid by you directly to Meta or Google from your own ad accounts. We never hold your ad money. We follow the spending limits you set, but platforms may occasionally spend slightly more than a daily limit; we pause ads when limits are reached.

5. No guaranteed results

Marketing results depend on many things outside our control, including your offer, your pricing and how quickly you respond to enquiries. Any estimates we show are rough guides, not promises.

6. Fees and billing

Plans are billed monthly in advance through Razorpay, plus applicable GST. Setup fees are one-time and non-refundable once setup has started.
WhatsApp message charges from Meta and ad spend are separate.
You can cancel with 30 days’ notice. If payment fails, we may pause the service after reminders.

7. Acceptable use

You may not use Tomtegrid for illegal products or services, spam, misleading claims, harassment, or anything that breaks platform rules. We may suspend accounts that do.

8. Liability

To the extent the law allows, our total liability is limited to the fees you paid us in the 3 months before the claim. We are not liable for losses caused by platform outages, account restrictions by Meta or Google, or content you approved.

9. Privacy

Our Privacy Policy explains how we handle personal data.

10. Law

These terms are governed by the laws of India, with courts in Hyderabad, Telangana having jurisdiction.
